Temporary Total Disability (TTD) Benefits

Request free consultation

Temporary total disability (TTD) benefits provide financial support for a person hurt at work and unable to return to work for a period of time. These benefits may help you to continue to meet your financial needs while you are unable to work. You must have specific qualifications to obtain them, and that often means proving your inability to work.

A Las Vegas work injury lawyer from DiMarco | Araujo | Montevideo can assist with your case.

Who Is Eligible for TTD Benefits in Nevada?

Under Nevada law, you may be eligible for TTD benefits if you suffer a work-related injury and a doctor certifies that you cannot do the tasks required of your job. Consider the following:

  • The injury must happen within the course and scope of your employment.
  • Your doctor certifies that you cannot work your job due to your injuries. That includes that your employer cannot accommodate modified work for you.
  • The workers’ compensation claim has been accepted, indicating that the accident was work-related.
  • You must miss more than three days of work or require an overnight hospitalization due to the injury.

If you believe you meet these qualifications, you may be able to seek a claim for TTD. A workers’ compensation attorney can help you to do that.

What TTD Benefits Include

If you are eligible for TTD in Nevada, you can receive two-thirds of your average weekly wages for the length of time you qualify. Maximum benefits are applicable. Your attorney will go over what your right to compensation is in these cases.

Typically, to determine the value of your recovery of losses, workers’ compensation considers the previous 12 weeks of work history. You are paid 66 2/3 of that value.

Benefits will continue until your doctor releases you from care. For example, if you are unable to work for a month and your doctor says you can return, the benefits will pay you for that missed time. However, there are other considerations here. For example, if your employer offers you work that accommodates the restrictions your doctor sets, you may be able to return to work and no longer receive TTD benefits.

IN some situations, you may reach maximum medical improvement, meaning you are no longer likely to see improvement in your injuries. Your benefits will stop at that point for permanent disability consideration.

How to Get TTD Benefits

If you suffer an injury at work, you can seek medical care right away. Document what happened, and be sure to inform your employer about your injuries immediately. Then, follow your doctor’s recommendations for care.

You will then submit a workers’ compensation claim that demonstrates your doctor’s restrictions on your return to work. The insurance company will review your case, ask questions, and then grant you compensation while you heal. Keep in mind that you will likely need to meet with a workers’ compensation medical provider to verify the accuracy of your injuries and limitations.
