  • Obtain any evidence necessary to prove liability (video or photo surveillance, accident reports, statements from eyewitnesses, and more).
  • Work to ensure their client is evaluated by a trusted medical professional.
  • Negotiate with everybody involved to obtain a fair settlement for their client.
  • Ensure that the case is filed within the two-year statute of limitations in place for Nevada personal injury cases.

Car Accident Injuries Can Be Devastating

Henderson is part of the Las Vegas metropolitan area, which means that there is plenty of traffic that both residents and visitors alike must contend with. Unfortunately, car accidents are not uncommon in this area, and they regularly occur due to the careless or negligent actions of other drivers. At DiMarco Araujo Montevideo, our car accident lawyers in Henderson regularly help clients who have been injured because of another driver:

  • Was operating while impaired by alcohol or drugs
  • Was operating their vehicle too fast for conditions
  • Failed to follow traffic laws
  • Failed to yield the right of way
  • Was operating while distracted by their cell phones or another device

Unfortunately, injuries caused by car accidents can be severe. It is not uncommon for our attorneys to help clients in the Henderson, NV area who have sustained the following:

  • Broken or dislocated bones
  • Severe bruising, sprains, or strains
  • Severe lacerations
  • Traumatic brain injuries or concussions
  • Spinal cord injuries
  • Other neck and back injuries or whiplash
  • Internal organ damage or internal bleeding

How Much Compensation Can You Receive?

If you or somebody you care about has been injured in a car accident in the Henderson area, there may be various types of compensation available for your claim. There is no set amount awarded in these cases, but the team at DiMarco Araujo Montevideo is regularly able to help clients recover the following:

  • All medical bills arising due to the crash
  • General household out-of-pocket expenses
  • Lost income if you are unable to work while recovering
  • Loss of personal enjoyment damages
  • Pain and suffering damages

How Long Do You Have to File the Car Accident Lawsuit in Henderson?

It is important to distinguish between insurance claims and lawsuits in these situations. Most insurance carriers require that the accident be reported as soon as possible after the incident occurs. This is usually within a day or two. Failing to report the incident to the insurance company in a timely manner could result in a claim denial or delay.

However, Nevada does have a two-year statute of limitations in place for car accident cases. This means that car accident injury victims have a two-year window with which to file a lawsuit against an alleged negligent party, or they will not be able to recover any compensation for their losses. This two-year clock starts running the day the accident occurs.

What if You Are Partially at Fault for the Car Accident?

Many car accident victims are led to believe that they cannot recover compensation if they were partially at fault for the incident. This is not true. Under Section 41.141 of the Nevada Revised Statutes (NRS), we can see that this state operates under a “modified comparative negligence” system. This means that a car accident injury victim can recover compensation if they are 50% or less at fault for the incident. However, the amount of compensation they receive will be reduced based on their percentage of fault.

For example, if a car accident victim sustained $100,000 worth of damages, but a jury determines that the victim was 20% responsible for the incident because of a busted taillight, then they would receive a reduced compensation of $80,000.

Any car accident victim that is more than 50% responsible for the incident will not be able to recover compensation, per Nevada modified comparative negligence law.

If you have been the victim of an accident caused by another party, please be aware that the other party may try to place some or all of the blame on you for the incident in an effort to avoid paying any compensation for the claim.

Hit and Run Car Accidents in Henderson

Hit and run accidents are an unfortunate occurrence, and it is rare that these at-fault drivers are apprehended and brought to justice. Drivers injured in a hit-and-run accident may be able to turn to their uninsured motorist coverage to recover compensation. This type of coverage is not required under Nevada’s auto insurance laws, but it is highly recommended.

Uninsured and underinsured motorist coverage can provide great benefits to drivers who are injured by uninsured motorists. In the event a hit and run driver is apprehended, it may be possible to recover compensation by filing a personal injury lawsuit against them. However, it is unlikely that these drivers will have the assets to be able to cover any damages awarded by a jury. Underinsured motorist coverage is beneficial if a person is injured by a driver with insurance limits that are inadequate to cover the total expenses. Underinsured motorist coverage will kick in to pick up the difference.
